Deviations are valid only if expressly agreed in writing.
Article 3 – Prices
All prices are exclusive of VAT, taxes, packaging, shipping costs and any import duties, unless otherwise stated.
For orders outside the EU, VAT is not charged. Any customs duties or local taxes are entirely the responsibility of the customer.
Luxtile Au Coin Du Feu SA reserves the right to change prices. Obvious errors or mistakes are not binding.
Article 4 – Condition of Goods
Goods are sold “As-Is / With All Faults”.
Customers may inspect goods prior to delivery or shipping, personally or through a representative.
If the customer waives this right, payment is deemed full acceptance of the goods in their condition.
Due to the nature of the goods (antique, unique, often custom-restored), no right of return or withdrawal applies.
Article 5 – Delivery and Ownership
If shipping costs are not automatically calculated, the customer will receive a separate quote within 12 hours.
Acceptance = order confirmed and shipped.
Rejection = order cancelled free of charge.
If the customer arranges transport (Ex Works / FCA Incoterms), the order is automatically confirmed and the customer is notified once the goods are ready for collection.
Place of delivery is always Luxembourg.
Ownership transfers to the customer only after full payment of the invoice.
Article 6 – Customs UK & Ireland
Shipments to the United Kingdom and Ireland require customs clearance.
The carrier appoints a customs broker, requiring a permanent power of attorney from the customer.
Private customers without an EORI number must state: “Private Person”.
Article 7 – Payment
Payment must be made exclusively to the specified bank account.
Restoration, packaging or shipping will only take place after full payment has been received.
Article 8 – Governing Law and Jurisdiction
All contracts and transactions are governed exclusively by Luxembourg law.
Jurisdiction lies with the courts of Luxembourg, to the exclusion of other jurisdictions.
Note: For consumers within the EU, mandatory consumer protection laws apply, including the right to bring claims in the consumer’s home country.
